They use the same example I did. Its also the example used in two of my Criminal Justice textbooks.

What you may not have realized is that in the article you posted the reason he was not subject to the murder-felony rule was because he wasnt the one who comitted the crime and wasnt at the scene of the crime. He lent his car (which is not a felony) to someone who killed someone while comitting a felony. Which is different than someone robbing a bank which leads to a heart attack.

Just out of curiosity why would you think a heart attack would be to remote to be blamed on the bank robbery?

I live in Florida, and we do have some wacky laws. Up until like three years ago, you could pretty much shoot someone just for trespassing on your property. Some guy not to far from where I live shot some kids because they rang his doorbell and ran,and the second time they did it, he opened the door and shot the kid because he said "he felt threatened",and he almost got away with it.

I really can't say they intended to kill this kid but there actions did lead to the kids death so they are responsible. They didn't pull a knife or gun on the kid and he was able to get away so I get the feeling they may have just been bullying the kid even if the motive was to steal the PSP. That in no way makes their actions right and they should serve their punishment. But I don't think this would be a crime that should equal the Death penalty. Unless they have no remorse for their actions then I say fry em.

@Vecha: If by chance I was in the situation you mentioned, guess what? I'd still deserve to be charged for murder. Why? Even though my direct action was assault, by committing the crime in the first place, I'd already jeopardized the well being of the victim; whether it'd be the mental or physical well being of the victim. My actions have caused a chain reaction: Battering the victim has caused mental anguish, impairing logic to supersede instinct ("I have to escape danger" becomes priority over "what's the safest way to do it"). If I hadn't attacked in the first place, there'd be no reason for the person to run and no reason for their judgement to be impaired while doing it.

People not giving a damn about these fools and wanting them to pay the harshest penalty for their actions isn't an act of mob rule, that IS justice. No one is asking for their death, just for them to be charged for the death they caused.

As an African American male who didn't always get what he wanted, but chose to earn what he could get legally, stories like these make me sick to my stomach.

These idiots were luckily caught, and deserved to be charged for murder as well as assault. Their actions are what led to that boy's death and to simply let them off for robbery is an injustice. They had their chance to better themselves, they chose crime. Even if they weren't intending to ever commit murder, their criminal activity led to it. They deserve no remorse.

Assholes can always go out and make an honest living going local, but chose the express track that is inevitably destined for derailment. Was a PSP really worth it?

Such a tragedy to see a life ended so early over something that means so little.. I mean, hell, I am a video game addict myself, but what kind of fucked up person would it take to beat someone up and chase them to their death over such a thing? What kind of upbringing did these kids have?

They should both end up in prison, but the parents of the 17 year old will more than likely end up taking most of the punishment. Perhaps they will regret not raising their child properly now.

Clearly, after seven other arrests, it doesn't seem like Goa is just some harmless kid pulling a robbery stunt, now, does it? And strong-arm robbery, for Brown? 1. Crime stats are down virtually across the board. We live in a safe country (assuming that country is the United States). 2. Of course intent matters. There's no way these two criminals will be charged with first degree murder. There is no "domino effect." This is by far one of the most idiotic legal arguments I've ever heard, and we should all be on guard for pending indictments! Maybe if I didn't get extra parmesan on my lasagna last night the waiter would have gone over to the table with the fussy child and prevented the plate from being knocked over, splattering the mom with pesto, and then she wouldn't have used her Tide pen in the car and been paying more attention when she ran that red light and oh my god what have I done? What a stupid argument.

There's causation, sure. They'll be charged with a lesser manslaughter or maybe negligent homicide, but since they didn't directly kill this poor boy, stop clamoring for the death penalty. It's distasteful enough, but in a case like this when it's so obviously not applicable, it just makes people look bad. People like Ca$h and I_Hate_This_Place need to take note, or else risk looking like they have the intellectual heft of a paperweight.

3. Don't blame the police for initially treating the death as "accidental." It's a safe default position for the police to use when starting an investigation. That's just common sense.

About 6-7 years ago, I was hanging out with some people, other kids of their town didn't like (I didn't know we just met a few weeks ago at a billiards hall). So they proceeded in the winter time to follow us, and throw full beer cans at my cars back window in the middle of winter. Luckily it didn't break anything. And so I lured them, since they were so hell bent and too "bad as and cool" to not follow, down this reservoir at a dead end road in the middle of nowhere. My buddies proceeded to unload from my car and go to town and smash all their windows and lights out in a 5 degree night.

Good luck explaining that one to your parents and cops.

Not everything has a better ending like we just explained unfortunately. And I feel for this kids family and friends. And lets just hope they get the justice they deserve, since the law has already failed them once!

My second thought is how much of a tragedy it really is. That's something that's relatively rare. While I don't figure he'd have changed the world, he was still going to work to make his own place in it.

I side with the murder charges and I commend the kid for standing his ground. If these two punks were willing to rob the kid and continue to chase him once he got away, lord knows how far they were willing to go for a mere toy. Letting them off on nothing more than a burglary charge is not justice served.

Let's look at it from a video game perspective. In the second level of Dracula X chronicles, when Richter is running from that huge half minotaur kind of monster, he can potentially fall into a pit and die. Now, yeah the pit was there, but he would've jumped safely over it had he not been running from the giant monster chasing him.

Just like, honestly, this particular young man would have looked both ways before crossing the street and not jumped out in front of a truck. These two kids chasing him killed him. They deserve to go to jail. End of story.

Sorry if the video game comparison was tasteless. Just trying to get the point across that these kids need to be charged with murder.

I didn't want to play a PSP on the subway back then, and I don't want to now. DS seems like a safer bet. (of course, Advance Wars is the real reason I went DS)

I'm sorry, but I have to object with the sanity of Florida. The two kids tried to beat the one kid down and take his PSP. They didn't point a gun at the kid, they didn't throw the kid in front of a truck. As pathetic of an example they serve as people, am I the only one here that thinks that second degree murder is a bit harsh in this case? Manslaughter perhaps, but murder?

Florida's fukt up, kids. Stay outta the south...
