At the same time, EA also knows that it is in a prime scenario where it can stand to gain profit by actually going through with legal actions, as the gaming community-at-large is watching to see the decisions of both Murdoch & Co. (News Corp's Fox News) and EA. EA probably realizes that it must give a reasonable amount of time to allow "Faux Boob Rattle" to attempt an error correction on their stories before making a case in court. A week or two is reasonable time.

EA also stands to lose profits if the gaming community-at-large ends up believing that it is just saber-rattling, and also stands to losing major credibility from it's dedicated gaming audience because this is the rare occasion where everything can be set straight in the general public forum.

EA just had the "Holy Grail of Public Relations and Reputation" fall on it's lap by a seemingly arrogant and ill-advised media outlet that wanted to pander and tittilate it's core audience with misinformation.

Don't just give it away, EA. The gaming community is counting on you to make a stand for the gaming community-at-large!

Do this, and I *WILL* buy Madden games every freaking-year! (And NCAA Football titles too if you don't half-ass the fight!)

Here's the thing. This FOX News report... it was a GOOD thing. Do you know WHY it was a GOOD thing? Simple: we get to cram it down the throats of a number of high ranking and out spoken individuals, organizations, and government groups who DIDN'T comment, let along CONDEMN the quality of the news report.

We've heard time and again from politicans such as Leland Yee (CA) or Senator Burrell (LA), and many others from Utah to NY. Organizations such as the PTC (Parent's Television Council) or the CSM (Common Sense Media) or even NIMF (National Institute on Media and the Family). We've heard from the self-righteous such as John Bruce "Jack" Thompson or the conspiracy theorists such as Lyndon LaRouche.

We've heard them all say how the ESRB does not properly research the games they rate. That the ESRB doesn't properly inform Parents so they can make appropriate choices for their children. We constantly hear how harried Parents are and how they supposedly don't have the appropriate resources to make wise decisions. We hear condemnation upon condemnation against the gaming industry. We hear condemnation upon condemnation against gamers themselves. We hear condemnation upon condemnation against reviewers and game news sites. We hear the cry of moral superiority over everything that is computer and video games. We hear claims that only the government can make the appropriate decisions for Parents as to what is or is not appropriate, whether it's in regards to video games or media in general.

But, WHERE ARE THEY NOW??? FOX News knowingly and INTENTIONALLY aired false information. Everyone at FOX News knew it. Proven just by the few statements allowed by Geoff Keighley, Cooper Lawrence had, in effect, openly lied. And other panelists aided in those lies. But where is the condemnation by politicians against FOX News for knowingly and intentionally LYING TO PARENTS who watched that story? Where is the condemnation against FOX News by the organizations and the self-righteous individuals?

They are all silent. Someone claims that video games are responsible for a crime, and the chatter from politicians, organizations, and the self-righteous never ends. FOX News lies to Parents about video games... and you could hear immortal crickets chirping on the moon.

I say this should be the battlecry. Not simply us screaming about and to FOX News and Cooper Lawrence. But us screaming "WHERE ARE -YOU-!" to those politicians, organizations, and self righteous individuals who've remained silent so far. I say if they have so much condemnation for us and our interests, then maybe we should have condemnation for their SILENCE.

I say not only should individuals be sending intelligent, respectful CONDEMNATIONS to their politicians, those organizations (and others) mentioned, and the self-righteous individuals mentioned (and others not mentioned), but so should our organizations such as the ECA, the VGVN (who until now has appeared as nothing more than a mouth piece), EA, even the ESA, among others.

I say it's time we pointed a few spotlights on those who failed to condemn FOX News' actions.

1. It puts FOX News on notice: we have lawyers. And a case against you would make us look like the good guys to a lot of people, regardless of the outcome. Not a lot of people think we're good guys, so this is a big positive for us.

2. It sends a signal to their employees that they will go to the mat for them, at least rhetorically.

3. It sends a signal to gamers that they will go to the mat for gamers too. I think there are a lot of gamers who are really, really tired of people who are literally ignorant maligning the industry.

As long as EA is a huge corporation, it is bound to act evil from time to time. This is true of all corporations, I think and is not a problem for special to EA. But there is a lot of room for maneuvering between Kinda Evil and Super Duper Evil, and I think this is a good fight to pick if one is thinking about moving in a positive direction on this scale.

As for this story, yeah, I think they can definitely take FOX to court for slander. Or, as someone mentioned earlier, at the very least they can take 'em for defamation. EA is in a pretty good position to do so, not only because they've got deep pockets, but also because unlike other companies that have had their product dragged thru the mud (Rockstar/Take-Two, basically?), EA has been for the most part about wholesome games.

Seeing as how IGN is owned by the same parent company as Fox News, I would like to see IGN staff members complain to Rupert Murdoch, I would hope that complaints from your own employees would carry some sway.

As for EA, I hope that instead of suing for money, that they demand 15 minutes of air time to speak their peace, along with other members of the industry (ESA, ESRB, Microsoft etc.) as well as some members of Bioware.

I think what EA should do is arrange interviews on rival news channels, because which network wouldn't jump at the chance to disgrace their rival. I think the interviews should include representatives of the groups I mentioned earlier, and should address the inaccuracies in the original broadcast, as well as some of the common misconceptions about gaming.

This is probably too much to ask for, but this I think, would be ideal.

I can certainly understand the underlying tone of why some people might think that it's bad for children and pre-teens to watch too much violence, or even at some point, too much sex in videogames and on TV. The thing is, though, with Mass Effect, we're not really talking about children from 6-17 years of age.

We're talking about M(ature) gamers or least what the ESRB has decided to be M(ature) gamers in the US & Canada. In most of Europe, the PEGI rating is 18+ which I simply don't understand - especially not with the content that was in Oblivion, and Oblivion got a 16+ rating..

In Germany Mass Effect has gotten a 16+ while in the UK it got a 12+ rating - due to moderate violence and one mild sex (or love scene) where you can see a sideboob and a bum (rear end) of a blue lady.

Even this much amount of sexual themes in Mass Effect didn't affect PEGI's rating as the 18+ rating was for 'violence' (shown by the displaying of closed fist icon on the back of the box). The guidelines clearly states that only [b]if[/b] the game itself is about sexual content, there should be added an icon for sexuality and nakedness. The guidelines also clearly states that the showing of a sideboob or a naked bum does not equal having put nakedness, full or partial in the game. It does so at the back of the box in the US version, e.g. there's a description for 'partial nudity' being in the game.

People buying this game know what they're buying, so to speak. Complaining about this after you've bought the game just seems a bit silly to me. I mean, it clearly says 'partial nudity' on the box, hence it must mean there's partial nudity in the game. And as said before - if you have a problem with either the partial nudity in this game or the violence level in this game, then just don't buy it - please...

As a final point, I'm happy with the direction EA is taking this. First the 'this is not a legal threat' and now the namethrowing of Riccitiello's name, meaning that gamers, thanks to EA, actually could get vindication for this and other incidents where people and journalists have outright lied about the content in a video game.

And as another final point, I don't think Mass Effect should be played by a 12 or 13 year old, let alone a 6 year, but I'm just a mean old conservative teacher in that way ;) (no -- just kidding - somewhat ;) ).

Recently you had a report about how the videogame Mass Effect had very crude images and and situations. The report started off as saying "Full Digital Nudity in New Game" or something relatively close. With just that statement you slapped many people in the face with that statement. You insulted the ESRB, EA, and their recently accquired studio BioWare. If Mass Effect had been even close to you claims then the ESRB would have given Mass Effect a rating of AO. For people who don't care about knowing the truth, that means adults only and would not be carried by any stores here in the United States. I will close this letter by saying that your motto "Fair and Balenced" is even more of a lie than your report on Mass Effect. To prove defamation you have to look at the plaintiff. If it's a private figure just showing that the statement was falst is enough. For public figures, as EA probably would be, you have to show some fault, negligence, malice, etc.

Anyways, it's been a long time since constitutional law, that's what i remember.
