Indeed they are. A decade or two back there was a tiff about them seizing paintings that some guy had been making as non-monetary compensation for stuff like hotel rooms. The recipients were fully aware that they were hand-painted images of one side (and one side only) of bills of various denominations, that he signed his own signature as, I believe, the Treasurer, and that as far as the US Government was concerned they had no real cash value. Legally, as long as it's immediately possible to distinguish a fake bill from a real bill through intentional means (Darth Maul wearing a Santa hat where Washington's face would normally be, bills printed in a significantly different color/size than a real bill, or one side is left blank), it does not count as a counterfiet bill, and the Secret Service shouldn't be able to say jack about it. However, the fact that he was handing them out in lieu of payment was apparently used to justify their actions. Then again, this wasn't too far off from the time they stormed Steve Jackson Games and took all their computers and coffee makers because they thought GURPS Cyberpunk was a guidebook on how to hack secure computer systems (it sorta was...if you allowed for the use of character stats and dice rolls...).

Making counterfiets is only SS jurisdiction. Passing them off probably constitutes fraud, and therefore maybe ventures into FBI territory. Besides, it's not like a beat cop can't arrest you for counterfieting if he witnesses it. He'll just be required to hand you over to the Secret Service after hauling you in. In this comic, however, it appears to be a pre-planned sting operation, in which case they surely should have been informed and would likely have operatives on site (though some other agency might be coopted to provide warm bodies if they can't get enough of their own there in time).
