Contributory negligence way out of the scope of intended use. No reasonable person on the planet thinks putting electronics in water is a good idea, especially non-portable ones. If we all used your logic, we could get rich jamming forks into electrical sockets or taking a big giant bite out of a cellphone.


I don't even think you could get an improper warning case to stick out of this.


And on the McDonald's Coffee thing:
I'm sorry, I think an old lady getting 3rd degree burns on 6% of her body and having to get skin grafts is worth huge damages, especially when McDonalds was serving coffee hotter than most other restaraunts. Especially when you figure people spill coffee all the time, and I can't even begin to count how many times I've gone through a drive through and had the lid on my drinks not all the way on the cup. McDonalds set itself up for it, and their out-of-court settlements prior to that indicate it was a known problem.

You want to know why the damages in that case were massive? You bring up an old lady who got burned on her lap, groin, and ass in front of a jury and have her describe the week in the hospital and the skin grafting procedure.


MS, OTOH, didn't set itself up for anything because some nimrod thought it would be smart to put an electronic device in water because he read it on the Internet. Way outside of the intended use. My TV doesn't have a warning about not putting it in the bottom of the bathtub so I can watch my stories while I take a shower. I could try to sue whatever company made the TV, but there's no way I'd win that.

Just because someone files a suit doesn't mean it has any merit or will win.

Almost zero conductivity I believe. It's because of the rampant impurities that allow your typical tap water to conduct electricity so well. Actually, I went and checked, baby oil is mineral oil with fragrances. So my edit wasn't even needed. It makes no damn difference. Besides, moving parts (the hard drive and disk drive) should not be submerged, the density of the oil would slow it down and most likely cause errors or even damage.

You're right it's admitted to being not only a defective product, but a defective design. I wouldn't be surprised to see worse cases than this leading up the holidays. It would be easy to get Microsoft to settle on something like that too.

His point was from a liability standpoint. 'The consumer' had to take action to make the 'defective product' work. The damning part is the infamous statements from Microsoft itself over the design defects. If someone burns down their house or dies they'll wish they did a recall after the wrongful death litigation. The last Xbox had a few cases of causing fires, but Microsoft never said in a conference call it's design was known to be defective. You see the difference? It wouldn't play very well legally or emotionally in court. Tugging heartstrings can open purse strings.
