I think it's because there is no R4 or Pandora or system hacking to get the official games for the device. Sure you can jailbreak it, but you only get homebrew games, not the officials from the app store.

Maybe if you had a pirated song you would go and buy the album, or if you had a pirated movie you'd want to see it on the big screen. But a pirated game you already have full access to? Somehow I don't see that check getting into the mail.
Depends on your needs, of course. I found the iPod touch to be not that much of a savings compared to an iPhone (remember, you need to be on AT&T to have phone service. You can get it to run on other SIM card based networks if you hack it, though).
Plus, the iPhone has a mic that's used in some applications. Not too important, really up to you.
@DanTheMagnum: Absolutely yes. I believe Wired did an article about it, but it's basically better to stay with the cell phone you have and just get yourself an iPod touch. You get more space for your money and you don't have to worry about AT&T's ridiculous plan and horrible coverage.
Personally, I have myself a 32GB iPod Touch, and a plain old cell phone that Alltell gave me for free and I absolutely love it.
@DanTheMagnum: Just as a bit of extra info, the iPod Touch doesn't have any speakers, so to hear game music, sound effects or anything else you'll need to wear headphones of some sort (or plug it into a dock). Don't get me wrong - I absolutely ADORE my iTouch, and it's probably one of the greatest commuter gadgets ever devised :)

plus there are a lot of free games (including demos) in the app store. did they factor those in?
I've probably paid for 3 things on my iPhone and one was the Ocarina. totally worth it. after jailbreaking it there's no point in paying though.

That's a really weak argument. Gee, it's gonna cost a lot of money to buy a lot of games? NO WAY.
