The "inspiration" looks a bit deeper than Generic-Looking WWII Shooter #21 borrowing a mechanic from Generic-Looking WWII Shooter #13.
From what I've read here and elsewhere, the gameplay itself is different enough to make Rolando its own game, but the art...?
This is one copyright infrigement lawsuit that wouldn't have me rolling my eyes and thinking, "Here comes the latest installment of our ongoing series: How To Make Your Own Frivolous Lawsuit."

Rolando and LocoRoco may share design (and style) elements, but they are two completely different games designed for completely different platforms. I'd happily recommend this to anyone who plays games and owns an iPhone.

Have you played Loco Roco?
Have you played Rolando?
Super Mario Bros. and Sonic do NOT share the gameplay and aesthetic similarities that Loco and Rolando do.
With that attitude I can only assume that you haven't, so let me try to put it perspective -
Mario and Sonic are like Apples and Oranges
Loco and Rolando are like Red Delicious Apples and Washington Apples, they're so close that if you really didn't know the difference you could mistake one for the other in a screen shot.
Seriously, the people claiming that this could cause a legitimate lawsuit over intellectual property aren't too far off from the truth.

If more developers can harness the iPhone like ngmoco:) has here, then I don't think there'll be any dispute on whether or not it's a viable gaming platform. Bravo.
