The lawsuit, submitted by Samuel Livingston of California, sought "actual damages, individual restitution, equitable relief, civil penalties, costs and expenses of litigation, including attorney's fees, and all further relief available." Well now Activision and Livingston have settled out of court, and Livingston made millions! MILLIONS! Okay, so he didn't get millions. What he, and every other owner of the defective version of the game got, was an extension on the replacement program until August 2008, and a free faceplate - the same faceplate they were already sending out anyway. Oh, and Activision promises not to make the faulty version of the game anymore. Wow. Next time Sam? Just fill out the damn form.

<![CDATA[ Activision CEO: $199 Consoles Or Die! ]]> bobby_kotick.jpgThere's a reason they pay Activision's chief executive officer Bobby Kotick the big bucks. He's got fresh insight on the video game buying consumer, a group whom he believes likes less expensive consoles. A progressive theory, to be sure, but Kotick wowed the financial community with his acumen, claiming that the PlayStation 3 and Xbox 360 need a price drop to $199 within the next two years to remain competitive. Furthermore, he's got his sensitive fingers so well placed on the pulse of the market that he believes the much cheaper Wii " is now setting a standard and an expectation" on console pricing.

Sure, go ahead and laugh at the mentally unstable man! I have a sneaking suspicion that he might be right about this one. Kotick will be vindicated, you'll see. It's just crazy enough to work, I say.

<![CDATA[ GHIII Wii Only Offers Mono Sound ]]> The consumer is officially prepared for the Wii graphics letdown, and if a you buy a game on the Wii that's uglier than the PS3/360 version, you wouldn't be surprised. But when Guitar Hero III is found to only play mono sound on the Wii (as opposed to the box-advertised stereo and Dolby Pro Logic II options), heads turn. According to one affected forum member on the Guitar Hero site, Activision is "looking into it right now," and the implication is that some horrible software problem is preventing users from playing a music game in its full spectrum—not that the Wii is incapable of the task.
