I'm pretty sure that there are exceptions to prevent foreign citizens from rushing onto a military base of embassy and giving birth to an American citizen. I strongly side with the family here. This isn't the first time a customer did their due diligence only to be undone by a late change in rules by a cruise line. The mom-to-be should get a cash refund. I don't get how that's even an issue. They took money for services they decided not to fulfill. How on Earth do they get to keep the money in that circumstance? The rest of the family I'd be fine getting vouchers. This DID ruin their trip. That they didn't want to risk losing all of the money they paid by not going at all is immaterial.

A certain amount is set aside to pay damages and anything not claimed will instead kick over to a charitable donation. In this case, there was a minimum that Rockstar had to pay as well as a maximum. If claims went over the maximum, everyone got less money. If they went UNDER, however, then a donation would be made to charity. So, you're not taking money from Rockstar unless it fell into the sweet spot between the minimum and maximum. As it stands, it fell nearly $900,000 under the minimum, so Rockstar is making a hefty donation to charity.

According to the Times article, that charity is the Entertainment Software Rating Board. So, instead of taking money from Rockstar, you would have taken money from the ESRB.

I mean, not all urban sandbox games have repetitive missions. The problem isn't necessarily the setting as the execution. The producers may have thought that it was enough to put Spiderman in the sandbox and walk away. But if you had a compelling and fully developed story that simply played out in a large free-roaming environment, that might be the real success.

The Touch sensitive notes are a good evolution of Rock Band's higher frets, but nothing I'll feel sad without. While I love the triburst, I hate the generic design. If they had a cool new licensed guitar, I might have held off getting a 2nd 360 guitar for GH, but as it stands I think I'll get the Aerosmith Les Paul and just get the standalone GHWT.

I'm still concerned about how much development effort is being poured into a music editor that will be really used by a tiny fraction of their users. Really doesn't strike me as a good use of resources, but maybe I'll be proven wrong. I just don't get why they keep pushing something that so few people will do anything with. Especially since it lacks vocals.

I'm all about the real guitars, though. I'd never consider a 3rd party guitar that wasn't based on a real guitar, not a rip-off-real-guitar-like-style-design. One thing the Rock Guitar Hero Band games have done is really turn me on to the history of guitar design and I really love a lot of Gibson and Fender's work and legacy. Corny or not, I feel much more like a rock god holding a faux Les Paul or Strat than I would holding a psuedo-designed guitar like controller.

He's fussing of the words "Genuine" and "Steakhouse" but he's ignoring the word "BRAND" that comes right after them. Its a brand name. That's how brand names work. They inspire associations. They are promises or guarantees. Its Marketing 101 and forgive me if I can't get worked up every time a company practices basic marketing. Seriously, this is the same thing they were doing when Philadelphia Brand Cream Cheese got its name in 1880. They had the decency to slap "BRAND" right there on the name, so its not even like its that deceptive.

The only issue I'm seeing is Consumerist's find on the website where the 100% Guaranteed Fresh is limited with unspecified restrictions. THAT I'd have a problem with, as that's no brand name and I don't understand how something can be 100% guaranteed and yet not. The brand is just that. Even if Richie doesn't like their brand name, its still just a brand name. Having restrictions apply to a 100% Guarantee, however, defies the laws of mathematics.

I always mockingly singing the song to my girlfriend, poking fun at her Coldplay fandom. I've got this whiny falsetto slur down pat for Yellow and Speed of Sound. Which is good, because about 68% of their songs sound exactly like those two. I swear, I know The Who did the same song about 100 times but Coldplay takes the trick to a whole new level with an artistic output distinguished for being so indistinguishable amongst itself.

Is it just me or is the point of GH's DLC increasingly seem to be tailored to record company marketing needs as opposed to game play? All the synergy doesn't seem to translate much for the player is all I'm saying.

See the issue here is that Legal Seafood wasn't free to say a conductor's face looked like a halibut. The carmen's union started threatening to go on strike over the ads and they got pulled. If they threatened a boycott, your point would be valid. They didn't. They threatened to shut down public transportation in a major urban center and as such got their way.

They are paid employees of the transit system. They can suck it up and deal with an ad campaign like this. I don't see ads getting pulled that insult CUSTOMERS of the train system. No, when CONSUMERS are insulted, its okay with the employees and employers alike. Attacking CUSTOMERS isn't a problem with any of them. Seems like insulting CONSUMERS might be a bigger issue at this site, rather than crying over employees who don't want to be subjected to the withering insults of a photograph of a dead fish.

I'd also say that Harmonix did a masterful job selecting the bonus tracks for Rock Band. While some bore the heck out of me, "Time We Had", "Day Late, Dollar Short", "Pleasure (Pleasure)", "Seven", and "I Get By" are all songs I REALLY enjoy listening to and have eagerly sought on on my own. A bunch of GH1 tracks I did the same with, including the oft-mentioned Evan Rats. Aside from that, Rock Band has taught me that I love Boston. GH2 made me a Cheap Trick fan. While I love Synchronicity, I hadn't heard much of Police's earlier work before Rock Band, either. Ditto on Killer Queen, I'm ashamed to say.

Sights like this are an epidemic around September 1. Its usually someone renting a truck and ignoring the signs, sometimes continue to drive for a mile a so not realizing they took off the roof like a can opener. Boston as a community never fails to find this hilarious so there always seems to be a ton of pictures of the damage. Good thing, too, as it seems to be a good source of evidence for potential civil lawsuits.

Side note, when I saw this on uHub I thought this seemed like a Consumerist story. Guess I was right.

Even then, though, there is no honest case here. The NFL has exclusive agreements with countless parties. As they are allowed to as a private enterprise. Of all the areas where there are valid anti-trust complaints about pro sports, this just isn't one of them. I'm not happy this has become all the rage, but its clearly legal and this case is shameful and should be tossed immediately.

That said, the drivers are being whiny. They are being paid. I, on the other hand, am a paying customer and that hasn't stopped the MBTA from selling ads that make fun of their riders. THAT is something worth getting upset about. I've seen one at least once a year that mocks train or bus riders for being shmucks, poor, or fat or some combination there-of. I don't recall the Carmen's union rising to my defense when their bus had a billboard pointing at the riders and insulting them, so I think they can find somewhat to get over themselves now. They are being paid to put up with this. The real controversy is when the sell ad space to mock their paying customers.

A sequel was always inevitable. I don't know why people assumed everything would be DLC when there is so much money to make off a new disc to ignore. I'd expect they diverted some choice tracks to RB2, as well, but whatever. I'll get it on day 1 because I know I'll like enough of the music for it to be a bargain. Just look at it as a big huge variety pack of DLC that doesn't take up room on your hard drive. My own wish list...

Import RB1 characters. I hope they have new character creation options, but lets allow us to carry over our RB1 characters at least.

More clothes/hair styles. Mind you, I think they did a good job, but that doesn't mean there isn't room for improvement. Some more diverse options for short hair would be nice, and maybe some indie-rock themed outfits. And not everyone wear's ties with jackets. And cargo pants for men! Well, you get the idea.

Cross-title DLC. I won't mind if some or even most future DLC requires Rock Band, but the RB1 stuff should work with RB2. This might allow them to include RB1 songs, too, though I don't think that's as essential. Release them as free downloads for RB1. Then hey! You've got them in RB2 without any need to verify ownership of RB1.

Bass world tour. Online band world tour. I think HMX has gotten the memo on that.

If you have the skill and the time, doing your own butchering will obviously cost less. But I think most consumers know they are paying for a service on that count. Its certainly a good tip for someone looking to save money, but its hardly a case of the consumer done wrong. There IS a reason the stores are charging more, after all. Now, if they inflate the price, that's a different problem. But just charging for the service provided is very reasonable, even if its a service some consumers choose to do themselves. Pre-cut meat is little different than frozen pizzas, cartons of orange juice, or packaged baked goods. You're paying for a service.

While the novel was undeniably anti-slavery and did play an important historical role in instigating the Civil War and eventual end of slavery, the book also serves to promote a number of racist and sexist stereotypes. That it was anti-slavery does not absolve it from scrutiny for its racist and sexist elements. Indeed, the novel is also credited for creating a number of literary stereotypes of black people which persist to this day. The problem is not that people regarded it as pro-slavery, but that they saw its characterizations as racist and its popularity acted to deeply embed those racist attitudes into popular culture. The author's intent and its cultural impact do not necessarily act in tandem. And an author's intent cannot absolve them from criticism for the results of their work, whether intended or not. It is not intellectually reasonable to suggest that author's intent trumps the audience reaction or any latent biases exposed. Literary criticism is not the process of divining the author's intent. It is also about examining the author's result, which may not perfectly align with their intent. Whether Rockstar intended to promote dehumanizing attitudes towards women isn't the point. There are clearly segments of the game which do and that an the issue no matter what was intended.
