According to the latest batch of NPD data, for the first time this decade, EA are not the #1 third-party publisher in the United States. Activision are. Driven primarily by sales of Guitar Hero II, as well as licensed properties like Transformers, between January and June they racked up USD$397.8 million in sales, compared to EA's $365.7 million. Sure, their victory may be short-lived (Madden and Rock Band should see to that), but that won't stop the free peoples of the world from enjoying the brief, sweet taste of freedom.

It's an American/English thing. Corporations are correctly referred to in both the singular and the plural depending on what source you use for your "standard". While it looks funny to most of us in America "Activision are..." and "EA are..." is perfectly proper grammar. I'm surprised you haven't noticed this before - Luke often uses English grammar.

The "are"s drive me nuts, too, but that's a matter of being an American grammar whore. I've grown accustomed to seeing "are" where my mind tells me it should be "is" around here, as well around other game-related news mediums, well enough to realize that our way isn't the only way.
It's just the better way. ;P
While this probably wont' last long in the short term, in the long term I imagine this is just the beginning. EA's total sucking has to catch up with them eventually, right?

Wait, I thought the "size" of third-parties was not measured by how much $$$ they made, but rather how many games are released. That would still undoubtedly keep EA in the safe zone.

That's impossible, even for a computer!
Madden will change that, but Rock Band won't. Despite the two games' respective quality, Guitar Hero III is going to outsell Rock Band. The name recognition combined with the lower price tag makes it pretty much a given.

Great. Just what I wanted in my freedom. How bout some new games? Not a once yearly remake of the same sports game, not a remake of a Japanese game made in 1998 and currently on its 14th version (see Guitar Freaks), but freedom defined as a new game.
Doesn't even have to wildly new or out there, just has to be not a blatant copy.
Let battle of the same game (rock band vs Guitar hero) commence.
With Burnout, Rock Band, Madden, NHL, millions of microtransaction dollars, and tons of others; I don't think this victory is really anything but a joke to EA.
Yes thay have done quite well pioneering the microtransactions so well haven't they!
