You may remember the class action lawsuit filed against Activision this past November on behalf of owners of the flawed, mono-only version of Guitar Hero III: Legends of Rock. The lawsuit, submitted by Samuel Livingston of California, sought "actual damages, individual restitution, equitable relief, civil penalties, costs and expenses of litigation, including attorney's fees, and all further relief available." Well now Activision and Livingston have settled out of court, and Livingston made millions! MILLIONS! Okay, so he didn't get millions. What he, and every other owner of the defective version of the game got, was an extension on the replacement program until August 2008, and a free faceplate - the same faceplate they were already sending out anyway. Oh, and Activision promises not to make the faulty version of the game anymore. Wow. Next time Sam? Just fill out the damn form.

Damn, he should have proceeded with the lawsuiot. Frankly we should have not had to fill out a form, Activision should had ceased production and have all of us return the the product with some monetary compensation for falsely advertisting, and continuing to sell a product without features. That settlement looks like a dumbass move.
@daisukeumon: Wouldn't it be awesome if we got money everytime a company screwed up, that'll just never happen though. I'd have been a lot less bothered by this whole deal if it hadn't been treated like some big secret. There was no recall, just a chance for those in the know to get a fixed copy, and Ativision to spend as little as possible.
Any advice to Sam is just going to go in and out one ear.

So have they straightened out the problems with the returns yet? (I saw a LOT of people being told they didn't send the right disc back) Is the new version really fixed? I haven't read too much about the actual "after-you-send-your-disc-back" portion of this story..

The lesson for today is if you don't have much of a case don't sue a major corporation. I wonder if someone would try to hook HD cables into that ancient piece of hardware!
At least the US got replacement discs. Over here in Germany, Activision is not even responding to post in the official forums about when we *might* get a replacement. They actually started to run TV ads for it again BUT keep selling the bugged version!

I just returned the sucker to activision for the "cover original costs and some profit $122" and bought the ps3 version.
